Terms and Conditions

Please read the following carefully before submitting your listing.

Terminology
In these Terms & Conditions unless the context otherwise requires:

“Activity” means any activity, class, group etc advertised through a FREE or FEATURED listing on www.whats-on.co.nz

“Organisation” means the company, group, person or persons who own, run, manage or represent the Activity. The submitter of any listing acknowledges that they have the authority to submit the activity listing on behalf of “the organisation”.

“Advertisers” are the submitters of any listing, whether a free listing, or a featured listing.

“we, us & our” are a reference to whats-on.co.nz ltd

“you & your” are a reference to you, the organisation or the representative of the organisation.

“Listing” means a listing on the website through which you advertise an activity. This includes Free and Featured Listings.

“Services” means one of more of the services offered by whats-on.co.nz Ltd from time to time, including Free listings, featured listings, message board, and any other services that whats-on.co.nz ltd may offer.

“Listing Period” is the 6 month period that the Activity Listing is displayed on the Website.

“Website” www.whats-on.co.nz

SPECIFIC WARNINGS

Services
Whats-on.co.nz provides a resource where activities can be advertised and searched for. In providing such listings we make no warranty as to the accuracy of the information with which we have been provided. Our service is to provide such information as will allow an interested party to contact an advertiser directly to find out more about that particular activity.

Your own risk
All contact between visitors to our site and the submitters of listings to the site are entirely at your own risk, as are any further transactions between such parties. Whats-on.co.nz takes no responsibility or liability for any real or perceived misconduct by those who utilise the website.

Content of Listings
Whats-on.co.nz accepts listings in good faith and expects that organisations will provide an accurate description of their activity.

Responsibility for the content of listings on this Website (including hyperlinks to advertisers' own websites) rests solely with the advertisers. The inclusion of any listing on the Website does not constitute a recommendation or endorsement of the advertised activity by whats-on.co.nz. Each advertiser is solely responsible for any representation made in connection with its listing.

Advertisers must ensure that all listings will comply with relevant New Zealand legislation including the Fair Trading Act 1986 (which covers making false representations). The advertiser agrees to indemnify whats-on.co.nz against all claims or costs arising out of any misleading information in the listing.

Whats-on.co.nz will endeavour to ensure that all details provided to us by the organisation are reproduced faithfully. However Whats-on.co.nz will not be held liable for any loss arising from an error in such reproduction.

Whats-on.co.nz reserves the right to change the design and set up of Listings without notice, and to make alterations to any aspect of the listing should it be considered necessary. Whats-on.co.nz accepts no liability for any loss arising out of such alterations.

Copyright
Advertisers must not copy descriptions of an activity from any website or other form of advertising as such copying may be an infringement of copyright. Any description you submit should be unique and informative.

Featured Listings may contain a picture or logo. The submitting Organisation is responsible for ensuring they have the right to reproduce any digital images that are supplied by them to whats-on.co.nz. The organisation supplying the images agrees to indemnify Whats-on.co.nz Ltd against all claims & costs arising out of any infringement of copyright for such images.

All digital images produced by Whats-on-co.nz from digital images supplied by organisations are the property of Whats-on.co.nz and shall not be reproduced without our permission.

Quality of Logo/Picture
You can provide a logo or picture for a featured listing to represent your Activity that will be displayed alongside your Listing. Logos or pictures which are blurry, of poor quality, too large or too small will be rejected. Please also read section above regarding copyright.

Liability
Whats-on.co.nz cannot be held liable for any loss or damages howsoever incurred, including consequential losses such as lost income, in connection with submitting a listing on the whats-on.co.nz Website.

Link to Personal Website
In the case of a Feature Listing whats-on.co.nz will (at our sole discretion) include one link per activity to a personal website. This website must relate only to the Activity listed on our web site. We reserve the right to refuse such links, or remove them without notice.

Payment
Whats-on.co.nz will email an invoice when a featured listing is submitted. Payment should be by direct bank deposit or internet transfer. Account details will be included on invoice. Payment should be received within 4 days or the listing will be withdrawn. Please ensure your reference number is included with your payment so it can be linked to your listing. 

Current charges for featured listings are $48 for a six month period, paid in advance.  A picture or logo can be added for an additional $8.  A hyperlink to your website can be added for an additional $14.

Whats-on.co.nz reserve the right to change prices or charges at any time without notice.

Special offers may also be offered from time to time.

Refusal, Termination or Withdrawal of Activity Listing
Whats-on.co.nz reserves the right to refuse to accept or withdraw any Activity Listing submitted without notice or explanation. Under no circumstances will any compensation be payable by whats-on.co.nz for any loss howsoever incurred, including loss of income, the time/cost involved in submitting the Activity Listing etc.

If whats-on.co.nz receives a complaint about a Listing, and that complaint, in our opinion is reasonably substantiated, we reserve the right to remove that Listing from our website without notice. Such complaints could relate to the accuracy of details in the Listing. In all cases our decision will be final. In this situation a refund will not be paid and under no circumstances will any compensation be payable by whats-on.co.nz for any loss real or perceived by the organisation whose listing has been withdraw.

The advertiser may choose to withdraw their Listing from the whats-on.co.nz website. If you wish to withdraw please notify us in writing.

The advertiser may also request that that their Listing is reinstated at any time during the listing period purchased. Please note that the listing period will not be extended to allow for the time when the Listing was not showing on the web site.

Level of Service
Whats-on.co.nz will make every effort to provide you with the best possible service. Whats-on.co.nz will do all it can as far as practical to ensure that the Website is available on the Internet at all times other than any downtime required for maintenance. However Whats-on.co.nz takes no responsibility for any system availability or for any loss that is incurred as a result of the Website being unavailable.

Whats-on.co.nz will contact the lister/advertiser periodically to advise information on special offers, expiry dates for listings, acknowledgement of changes etc.

Promoting your Activity
Your activity must be described accurately. Please describe the nature of the activity and the benefits for those participating. Visitors to the website also appreciate details on where it is held, the cost and what days and times it runs. Providing them with contact details allows them to enquire further if needed.

Keeping up to date
Please keep your listing up to date. Email us with changes and they will normally be made within 48 hours of receipt.

Changes to Featured Listings
Once listed, you can update your listing for FREE on one occasion during the six month billing period. Additional changes are allowed but incur a small admin charge of $3.60 per change.

Intellectual Property Rights
Whats-on.co.nz (and its licensors or suppliers, as applicable) owns all proprietary and intellectual property rights in the Website and such software or other material that forms part of the services offered by the Website. Without prior written permission, you are expressly prohibited from copying, reproducing, or using any aspect of the website including text, graphics, and logos.

Acceptance of terms & conditions
Our Terms & Conditions are the terms on which whats-on.co.nz allow you access to our website, and to our services. Use of our services or completion of the registration pages on our Website confirms your agreement to our Terms & Conditions.
Amendments of Terms & Conditions
Whats-on.co.nz reserves the right to amend these terms & conditions in whole or in part from time to time. Amendments will be effective immediately from the time the amended terms and conditions are posted on this website. You are responsible for ensuring you have read and accept the latest terms and conditions. Your continued use of the services of the website represents your acceptance of the amended terms and conditions as posted.
